You are required to read the provisions in this User Terms and Conditions (these “Conditions”) and agree to them as it relates to your use of the Sonic Shipping services and platforms, including your purchase of items through our website and your use of all our social media channels (collectively, our “Services”). Additional terms and conditions may apply when you use certain parts of our Services. Please, read all the terms and conditions.

You are also expected to print a copy of these Conditions for future reference and read all other policies and agreements established through the Sonic Shipping website, including our Privacy Policy.

In these Conditions, ” Sonic Shipping ” or “we” or “us” or “our” refers to Sonic Shipping and subsidiaries while “you” or “user” or “your” refers to anyone accessing our website and/or purchasing items through it.

Your use of our Services constitutes your acceptance of these Conditions. If, otherwise, you do not agree to be bound by provisions in these Conditions; you do not have our permission to use our Services, including accessing our website.

Notice To International Customers

Information for International Customers.  We offer to ship to some countries outside the United States. The amount shown at checkout is for shipping charges, including any import duty or taxes charged by your country, brokerage charges applied by the shipping carrier, or currency conversion fees. Any additional charges are due at delivery and are the responsibility of the recipient. Consult your local customs office to determine what fees if any, your country may charge. If you refuse the delivery because of non-payment of these fees, your items will be abandoned by the shipping carrier and you will not receive a refund.

For any international order, you are solely responsible for ensuring you comply with all applicable local/state/federal regulations concerning the import. 

USD.  We process all transactions in USA dollars (USD). Your card issuer will convert currency at the prevailing exchange rate. Many credit/debit card issuers charge a fee or percentage for transactions, not in your native currency. Any such fees are the customer’s responsibility.

Changes To The Terms & Conditions

We may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Website thereafter. However, any changes to the dispute resolution provisions set forth in Governing Law and Jurisdiction will not apply to any disputes for which the parties have actual notice on or prior to the date the change is posted on the Website.

Your continued use of the Website following the posting of revised Terms and Conditions means that you accept and agree to the changes. You are expected to check this page frequently, so you are aware of any changes, as they are binding on you.

Registration

To access some of the services the Site has to offer, you may be asked to provide registration details. It is a condition of use of the Site that all the details you provide be correct, current, and complete. To the extent that a regular or partner account is established, it will be your responsibility to maintain the confidentiality of such information, including any username or password information.

You also agree that Sonic Shipping may, in its sole discretion and without prior notice to you, terminate your access to the Site and your account for any reason, including without limitation: (1) attempts to gain unauthorized access to the Site or assistance to others attempting to do so, (2) overcoming software security features limiting the use of or protecting any content, (3) discontinuance or material modification of the Site or any service offered on or through the Site, (4) violations of this Terms and Conditions or Express’ Privacy Policy, (5) suspected or actual copyright infringement, (6) unexpected operational difficulties, or (7) requests by law enforcement or other government agencies. You agree that Sonic Shipping will not be liable to you or to any third party for termination of your access to the Site.

We will assume (and by using the Site you warrant that) you have the legal capacity to enter into the agreement set out in these Terms and Conditions (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).

Use of The Sites

The purpose of the Sites is to provide you with information and to provide and enhance the services that Sonic Shipping offers. You agree your access to any of the Sites and their contents, shall be solely used for obtaining information and/or services and that you shall not use your account or otherwise access any of the Sites or their contents to directly compete with or gain a competitive advantage over Sonic Shipping. You shall not disrupt or otherwise interfere with the normal operation of the Sites, including without limitation posting or transmitting files that contain viruses, worms, Trojan horses, or any other contaminating or destructive features, or material that is harmful, offensive, threatening, abusive or hateful. You shall not access or use the Sites in any manner that violates state or federal law.

You shall not use any robot, spider, scripting program, “page-scrape” or another automatic or manual device, program, algorithm, or methodology to access, monitor, upload, download, “scrape,” or otherwise copy any portion of the Sites or their contents without the express prior written consent of Sonic Shipping . You shall not reproduce or circumvent the navigational structure or presentation of the Sites to obtain or attempt to obtain any content of any portion of the Sites.

You agree that violation of these Terms and Conditions constitutes an unlawful and unfair business practice causing irreparable harm to Sonic Shipping for which monetary damages would be inadequate, thus subjecting you to injunctive or equitable relief in addition to any other remedies available at law.

Sonic Shipping cannot and does not represent or warrant that the files available for downloading through the Sites will be free of infection, viruses, worms, Trojan horses, or other code that manifest contaminating or destructive ties. You assume all risk and responsibility for your use of the Sites and the Internet.

Transmissions And Submissions To The Site

If you transmit, submit or post information to the Site that is not Federally trademarked and/or copyrighted, you automatically grant Sonic Shipping and its affiliates and assign, the worldwide, fully-paid, royalty-free, exclusive right and license to use, copy, format, adapt, publish and/or incorporate any or all such information in any media whatsoever, including, without limitation, the Content (as defined below).

You shall not transmit, submit, or post the following to the Site:

Information that infringes Sonic Shipping’s or any third party’s copyright, patent, trademark, trade secret, or other proprietary rights.

Information that violates any law, statute, ordinance, or regulation.

Information that is trade libelous, unlawfully threatening, unlawfully harassing, defamatory, obscene, explicit or vulgar, or otherwise injurious to Sonic Shipping or third parties or that infringes on Sonic Shipping’s or any third party’s rights of publicity or privacy.

Information that contains any viruses, worms, Trojan horses, trap doors, back doors, Easter eggs, time bombs, cancelbots, or other code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, interfere with, surreptitiously intercept or expropriate any system, data or personal information.

Information containing or constituting chain letters, mass mailings, political campaigning, or any form of “spam”.

Information that is false, inaccurate, or misleading.

Commercial advertisements or solicitations without written permission from Sonic Shipping; or

Federally Trademarked and/or Copyrighted information without written permission from Sonic Shipping.

Although Sonic Shipping does not regularly review your transmissions, submissions, or postings, Sonic Shipping reserves the right (but not the obligation) to edit, refuse to post, or remove your transmissions, submissions, or postings. Pursuant to the Privacy Policy, Sonic Shipping may review transmissions, submissions, or postings made by you to determine, in its sole discretion, your compliance with these Terms and Conditions.

You are solely responsible for all your transmissions, submissions or postings (i.e., your own User Generated Content) and the consequences of transmitting, submitting or posting them.

Sonic Shipping Intellectual Property Rights

Zip Express’s names, graphics, logos, page headers, button icons, scripts, and service names are trademarks or trade dresses of Sonic Shipping in Jamaica and/or other countries (collectively, the “Proprietary Marks”). You may not use the Proprietary Marks without the prior express written permission of Sonic Shipping, which permission may be withheld at Zip Express’s sole discretion. Sonic Shipping makes no proprietary claim to any third-party names, trademarks, or service marks appearing on the Site. Any third-party names, trademarks, and service marks are the property of their respective owners.

The information, advice, data, software, and content viewable on, contained in, or downloadable from the Site (collectively, the “Content”), including, without limitation, all text, graphics, charts, pictures, photographs, images, line art, icons, and renditions, are copyrighted by, or otherwise licensed to, Sonic Shipping or its Content suppliers. Sonic Shipping also owns a copyright of a collective work in the selection, coordination, arrangement, presentation, display, and enhancement of the Content (the “Collective Work”). All software used on the Site (the “Software”) is the property of Sonic Shipping or its software vendors and is protected by Jamaica and international copyright laws. Viewing, reading, printing, downloading, or otherwise using the Content and/or the Collective Work does not entitle you to any ownership or intellectual property rights to the Content, the Collective Work, or the Software.

You shall be solely responsible for any damage resulting from your infringement of Zip Express’s or any third party’s intellectual property rights regarding the Trademarks, the Content, the Collective Work, the Software, and/or any other harm incurred by Sonic Shipping or its affiliates as a direct or indirect result of your copying, distributing, redistributing, transmitting, publishing or using the same for purposes that are contrary to the terms and conditions.

Quotations Not Binding

Quotations as to fees, rates of duty, Logistics charges, and other charges given by Sonic Shipping to Customers are for informational purposes only and are subject to change without notice; no quotation shall be binding upon Sonic Shipping unless Sonic Shipping in writing agrees to undertake the handling or transportation of the shipment at a specific rate or amount set forth in the quotation and payment arrangements are agreed to between Sonic Shipping and Customer.

Sonic Shipping As An Agent

Sonic Shipping acts as the agent of the Customer for the purpose of providing Sonic Shipping services for the Customer, including without limitation, duties in connection with the entry and transportation of goods, sale of goods, tracking of goods, delivery of goods on behalf of the Customer, and all other dealings with government agencies, or for arranging for transportation services or other logistics services in any capacity other than as a carrier. As to all other services, Sonic Shipping acts as an independent contractor in relation to the Customer.

Trademarks, Copyrights, and Restrictions

This site is controlled and operated by Sonic Shipping or its representatives. All material on the Site, including, but not limited to, images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, registered and unregistered, and other intellectual property rights which are owned and controlled by Sonic Shipping or by other parties that have licensed their material to Sonic Shipping. Material from any website owned, operated, licensed, or controlled by Sonic Shipping may not be copied, reproduced, republished, modified, uploaded, posted, transmitted, or distributed in any way, including by email or other electronic means unless otherwise agreed to in writing by Sonic Shipping. The materials on the Site may not be used for commercial benefit without prior expressed written permission by Sonic Shipping.

When you access a non- Sonic Shipping website through the Site, please understand that it is independent of Sonic Shipping and that Sonic Shipping has no control over the content on that website. In addition, a link to a non- Sonic Shipping Web site does not mean that Sonic Shipping endorses or accepts any responsibility for the content, or the use, of such website. It is up to you to take precautions to ensure that whatever you select for your use is free of such items as viruses, worms, Trojan horses, and other items of a destructive nature.

Tracking Updates

In addition to the Sonic Shipping Terms and Conditions, the following additional terms and conditions govern the access and use of this tracking update subscription application to request tracking information updates (“Tracking Updates”). Sonic Shipping authorizes You to request Tracking Updates for a shipment for which You are the shipper or recipient, and You agree to only request Tracking Updates for a shipment for which You are the shipper or recipient subject to these Terms and Conditions. You acknowledge and agree that Tracking Updates are the private property of Sonic Shipping, are provided to You free of charge, and that any use of Tracking Updates information is at Your sole risk. Tracking Updates are provided “AS IS” and Sonic Shipping disclaims all Warranties or conditions, Express or Implied.

Customs, Duties, and Taxes

Sonic Shipping is not responsible for any customs and taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer (tariffs, taxes, etc.).

Damages

Sonic Shipping is not liable for any products damaged or lost during shipping. If you received your order damaged, please contact the shipment carrier to file a claim.

Please save all packaging materials and damaged goods before filing a claim.

LIMITATION OF LIABILITY

Indemnification

Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the Website shall be instituted exclusively in the federal courts of Jamaica or the courts of the city of Kingston, although we retain the right to bring any suit, action or proceeding against you for breach of these Terms and Conditions in your relevant jurisdiction. You waive all objections to the exercise of jurisdiction over you by such courts and to the venue in such courts.

Entire Agreement

These Terms and Conditions and our Privacy Policy constitute the sole and entire agreement between you and Company with respect to the Website and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website.

No Waiver

No failure or delay by us in exercising or enforcing any right under these Terms and Conditions shall operate as a waiver thereof or limit, prejudice or impair our right to take any action or to exercise any right as against you.

Severability

If any provision under these Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such an invalid or unenforceable provision shall be severed and shall not affect the validity and enforceability of the other valid and enforceable provisions.

Sonic Shipping has the right, at its sole discretion, to modify these Terms and Conditions and to change, suspend or discontinue all or any portion of the Sites at any time, without notice, with such changes effective upon posting on the Sites.
